Paris, December 10, 2013 — Despite the significant citizen mobilization and the many reviews expressed against it, the Senate has just adopted the law Project relating to military programming and its dangerous provisions without any modification. This conforming adoption by the senators puts an end to the parliamentary work on this text: only the Constitutional Council can now prevent the application of these provisions which violate the fundamental freedoms of citizens. La Quadrature du Net solemnly calls on parliamentarians to submit a referral to the Constitutional Council for the latter to rule on the conformity of this law with the Constitution.
By adopting the bill relating to military programming for the years 2014 to 2019 without any modification, the senators have just put an end to the legislative work of Parliament on this file. Despite the many warnings expressed by both citizen organizations1 only by public authorities2, the text adopted today allows:
- real-time capture of information and documents (which “can be collected on request from the network and transmitted in real time by the operators to the agents mentioned”) from both hosts and service providers.
- to request or capture “information or documents processed or stored by their networks or services”, and no longer just connection data.
- the extension of the list of administrations that can require these interceptions or captures, for example the Ministry of the Economy and the Budget.
- broadening the purposes of these measures to safeguard the "scientific and economic potential of France" and prevention “organized crime or delinquency”.
At this stage of the procedure, only the Constitutional Council can still prevent the application of these measures opening the door to a general surveillance of information and communications on the Internet. This will only be able to examine the constitutionality of the text adopted this afternoon with the referral of 60 parliamentarians, the Prime Minister, or the President of the Republic. La Quadrature du Net solemnly calls on the elected representatives of the two chambers of Parliament to hear the appeal of the citizens, and to file a request for a constitutional review as soon as possible.
