Bettencourt case: Bilger deems the opening of a judicial investigation inevitable

It would seem that the voices are beginning to carry, and that some are asking questions about the independence of justice in the context of the Bettencourt affair and the non-appointment of a dedicated judge.

The Advocate General at the Paris Court of Appeal considers "inconceivable" that the Nanterre prosecution does not open a judicial investigation in the Bettencourt case in the long term.

The magistrate Philippe Bilger, general counsel at the Paris Court of Appeal, estimated Friday, July 23 in an interview with AFP "inconceivable" that the Nanterre prosecution will not open a judicial investigation in the Bettencourt case in the long term.

"It is not a question of impugning Philippe Courroye's intentions. I do not doubt the sincerity of his answer, nor the good faith that he implements in his investigations. But it would be inconceivable that it does not open a judicial investigation when the investigations return to the prosecution," said Philippe Bilger.

"The action of justice" in doubt

"Mr. Courroye has opened three preliminary investigations into this case. We have to wait to see what he will do, but it seems obvious to me that if one of these investigations does not lead to the opening of a judicial investigation, the doubt will be thrown on the action of justice", added the magistrate.

Speaking on the rivalry between the public prosecutor and the judge Isabelle Prevost-Desprez, in charge of a concurrent investigation into the clandestine recordings, Philippe Bilger considered that this situation "does not give justice a reasonable image".

"When personal enmities take precedence over questions of justice, one can only be confused," said the magistrate. "We have the impression in this case that there is no longer a pilot in the judicial plane," he added.

Many voices have been raised in recent days within the judiciary to demand the appointment of a independent investigating judge in the Bettencourt case. A "call for independent and impartial justice", launched by Mediapart, had collected some 30.000 signatures on Friday.
