ACTA: the European Parliament imposes its requirements

Would you rather I talk to you about GTX480 that we know or ACTA? So let's talk about ACTA and this "written declaration 12" which throws a stone into the pond and which tries to safeguard our freedoms against this steamroller that are the representatives of ACTA. I call them 'representatives', because we cannot speak of negotiators. In any case, this text, written by Françoise Castex and others (you will find the list below), is the first to take up the defense of European citizens taken hostage by these lobbyists. We welcome the initiative while hoping that there are others.

Hadopi had known about amendment 138. Acta will have to coexist with the " written statement 12 of the European Parliament. The text, a resolution which sends a strong signal against the security negotiations around the ACTA Treaty, recorded yesterday 377 signatures. The document has therefore acquired all its political force in the current negotiations.

« The international treaty (ACTA) should be finalized during the 11th round of work at the end of September in Tokyo, this declaration serves as a strong message to the negotiators applauds the NURPA (Net Users' Rights Protection Association). " This is a unique opportunity for MEPs to affirm with a common voice that intellectual property must not prevail over fundamental freedoms and public health. ».

A strong political message

“Declaration 12” indeed denounces “ the lack of a transparent process and the presence of potentially controversial content regarding the Anti-Counterfeiting Trade Agreement (ACTA) ". In addition to this absolute transparency, the European Parliament recalls fundamental basic principles threatened by the ACTA treaty, such as the fact that this agreement " should not indirectly impose the harmonization of European legislation on copyright, patents or trademarks and that the principle of subsidiarity should be respected. »

No rush, real independent reviews

Written by Françoise Castex (
our interview), Zuzana Roithová, Alexander Alvaro, Stavros Lambrinidis, Declaration 12 marks an important victory. " The proposed agreement, asks this Declaration, must not impose restrictions on legal process or weaken fundamental rights such as freedom of expression and the right to privacy. ". In response to the Gallo report and to Commissioner Michel Barnier, very much inspired by a study commissioned by the number 1 of Vivendi, the text " stresses that an assessment of economic and innovation risks must precede the introduction of criminal sanctions in cases where civil measures are already in place way of not adopting anything under the pressure of powerful lobbyists.

A declaration guaranteeing neutrality

Other notable points that will satisfy technical intermediaries and followers of neutrality: “ internet service providers should not be held liable for any data they transmit or host through their services to an extent that would involve prior monitoring or filtering of such data and, since Acta is also about health, " any measure aimed at strengthening skills in terms of cross-border control and seizure of goods cannot undermine access to legal, affordable and safe medicines on a global scale. »

A statement sent to all political structures

The declaration, accompanied by the names of the signatories, will now irrigate all European political bodies. It will be submitted to the Council and the Commission, as well as to the parliaments of the Member States, accompanied by its 377 signatures.

« This shows the sensitivity of European parliamentarians on questions and issues related to ACTA. They did not at all appreciate being kept out of the negotiations for so long. With this declaration, the European Parliament enters into the debate from which we wanted to keep it on the sidelines. This written statement does not anticipate what Parliament's vote might be once the agreement is signed, but sends an important signal to the Commission “Warns Françoise Castex, MEP from Gers. " It is also proof that the European Parliament, which has continued to push back France and the Member States in their desire to control the Internet, will remain attentive and will protect the individual freedoms of our fellow citizens to the end! »
